Form SSA-789 Request for Reconsideration - Disability Cessation Right to Appeal

What Is an SSA-789 Form?

Form SSA-789, Request for Reconsideration - Disability Cessation is a form used for filing request to reconsider cessation of disability benefits. The form was issued by the Social Security Administration (SSA) with the latest version of the document released in January 2019.

An SSA-789 fillable form is available for download and digital filing below. You can also find the up-to-date document at the SSA official website.

If the SSA decides that you are no longer eligible to receive your Social Security disability benefits, they will notify you about the termination of your payments. However, in most cases, you have the right to appeal this decision. The right to appeal depends on the reason your benefits were terminated. To initiate the appeal, you need to submit the SSA Request for Reconsideration. If you want to continue receiving your benefits during the appeal process, fill out and submit Form SSA-789 within 10 days since you received the termination notice. In general, you have 60 days from the date you received the notification to submit the form and initiate the appeal.

I DO NOT AGREE WITH THE DETERMINATION TO STOP DISABILITY BENEFITS AND I REQUEST RECONSIDERATION.
My reasons are (reasons should relate to the basis for stopping disability benefits and be as specific as possible):
NOTE: If the notice of the determination on your claim is dated more than 65 days ago, include your reason for not making this
request earlier. Include the date on which you received the notice.
I AM SUBMITTING THE FOLLOWING ADDITIONAL INFORMATION (If "NONE" write "NONE")
(Attach additional page if needed):
CHECK BLOCK 1 AND THE STATEMENTS THAT APPLY OR CHECK BLOCK 2
1. I (and/or my representative) wish to appear at a disability hearing. The disability hearing will be with a person called a
disability hearing officer and it will let me explain why I do not agree with the decision to stop benefits.
I need an interpreter at the disability hearing - Language
(If you need an interpreter, SSA will provide one at no cost to you.)
OR
2. I do not wish to appear nor do I wish a representative to appear for me at the disability hearing. I have been
advised of my right to have a disability hearing. I understand that a disability hearing will give me a chance to present
witnesses. It will also let me explain to the disability hearing officer why my disability benefits should not end. I
understand that this chance to be seen and heard could help the disability hearing officer learn about the facts in my
case. The disability hearing officer would give me a chance to have people who know about my condition give
information and explain how my condition keeps me from working and restricts my activities. I have been told about my
right to representation at the disability hearing, including representation by an attorney or other person of my choice.
Although the above has been explained to me, I do not want to appear at a disability hearing, or have someone
represent me at a disability hearing. I prefer to have the disability hearing officer decide my case on the evidence in my
file, plus any evidence that I submit or that may be obtained by the Social Security Administration. I have been advised
that if I change my mind, I can request a disability hearing prior to the writing of a decision in my case. In this case, I can
make the request with any Social Security office.

What Is the Difference Between Form SSA-561 and Form SSA-789?

Form SSA-561-U2 (Request for Reconsideration) is the document that allows you to ask the SSA to reconsider the decisions they made regarding your benefits. These decisions may include denial of disability benefits, eligibility for special veteran benefits, and recalculation of your benefits. This form is usually filled out to appeal the initial claim while Form SSA-789 is used to appeal the decision to stop the disability benefits that were paid for some time.

How to Fill out Form SSA-789-U4?

The document consists of two pages. It takes about 13 minutes to complete the SSA Request for Reconsideration. This includes reading the instructions, gathering all the required data, and answering the questions.

  1. Provide the name of the claimant exactly as shown on the cessation notice.
  2. Specify the Social Security number (SSN) of a claimant.
  3. If the claim number holder is different from the claimant, provide the applicable name and SSN in the next lines. Always indicate the claimant's SSN first, even if it is not the claim number.
  4. In case of supplemental security income, provide the name and the SSN of your spouse.
  5. Choose the type of benefits you ceased to receive.
  6. Provide the reasons you request the reconsideration of your entitlement. Be as specific as possible. If the termination notice was issued more than 65 days ago, provide the reason why you did not submit your claim earlier. Specify the date you received the termination notice.
  7. Specify the additional information you submit. If you do not submit any additional information, enter "None". If the space provided is not enough, attach additional sheets.
  8. Choose if you wish to appear at your disability hearing. You may designate the legal representative to appear for you.
  9. If you need an interpreter at the hearings, check the applicable box, specify your language and the SSA will provide you one for free.
  10. The document should be signed either by the claimant or by a legal representative.
  11. If the form is signed by the representative, it is still necessary to provide the full mailing addresses for both, the representative and the claimant.
  12. If you signed the document by mark "X", ask two impartial witnesses who know you to sign the document and to provide their mailing addresses.

Where to Mail Form SSA-789?

Mail or take the completed form to your local Social Security office. The full list of the offices is provided at the SSA official website. You can also find the applicable office in your telephone directory under U.S. Government agencies or by calling the SSA phone number indicated on the form.
