What Is a Delaware Firearm Bill of Sale?

The Delaware Firearm Bill of Sale is a document you fill out when transferring different types of guns from one party (the seller) to another (the buyer).

The document can be used by both, firearms dealers and non-licensed sellers. According to Delaware law, you are not obliged to complete the form during the gun transfer, but you may want to have one. The form is responsible for:

  1. Being the material evidence of the gun transfer.
  2. Serving as the purchase receipt for the buyer.
  3. Containing important information about both parties of the deal and the sold item(s).
  4. Releasing the previous owner from any liability for the use of the gun from the date of sale.

How to Sell a Gun in Delaware?

Include the following information when creating your Delaware Gun Bill of Sale:

  1. The names, physical addresses, and driver's license numbers of both the sellers and the buyers. If there is more than one seller or buyer, specify the identification information for all of them;
  2. Provide the firearm's details. Make sure the document contains the make, type, caliber, and the serial number of the gun you are selling. If the gun has any blemishes, describe them as well;
  3. Enter all details of the deal, including the sales price, the date of sale, and any special conditions;
  4. Add a clause that explains if the seller provides any warranty or the buyer takes the gun "as-is."

Create the document in two original copies. Both copies must be signed by the seller and the buyer.

Before you sign the bill of sale and transfer the firearm as a private non-licensed seller to any person in Delaware, make sure you strictly followed the official transfer procedure. The state law says that the prospective buyer must be subject to a criminal background check first. The background check can be initiated only by the licensed gun dealer who may charge up to $30 for each check. If 25 days pass since the licensed dealer's request and the FBI has not denied it, you are free to proceed with the transfer. To complete the background check and the firearm transfer, both you and the buyer must appear together in the office of the firearm dealer. Note that if you transfer your firearm without following this procedure, you will be liable for a Class A misdemeanor.

Does a Firearm Bill of Sale Have to Be Notarized in Delaware?

Delaware does not require a notary public's certification for firearm sales but it is generally a good idea to have a notary or witness to a firearm sale in order to confirm the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
