What Is a Massachusetts Firearm Bill of Sale?

A Massachusetts Firearm Bill of Sale is a document used to record the basic details of a firearm transfer from a current owner to a new one. Massachusetts Gun Carry Laws

Massachusetts gun laws are rather strict compared to other states. In order to possess or carry a firearm within the state, you need to have either a License to Carry (LTC) or a Firearm Identification Card (FID). The license is required for both concealed and open carry firearms. The state law also prohibits owning a firearm with a magazine capacity of over 10 rounds. However, magazines manufactured before 1994 are exempt from this restriction.

When selling your firearm, you must remember that you are not allowed to transfer your gun to anyone other than a person possessing a valid license issued by the Commonwealth of Massachusetts. It is strongly recommended that you ask the buyer to show you their LTC or FID, and check the validity of this document.

Though the laws of the Commonwealth do not oblige you to fill out a Bill of Sale during a firearm transfer, you are still advised to do it. If properly filled out, the document makes your deal more safe and protected.

Complete the document as follows:

  1. Enter identification information about the seller. Include their full name, date of birth, and LTC or FID license number;
  2. Provide the same set of information about the buyer;
  3. Enter a detailed description of the firearm you are selling. Specify the make, model, caliber, serial number, and other essential details;
  4. Indicate the sales price of the gun;
  5. Provide the date of sale;
  6. If you and the buyer agreed upon any specific terms, specify them as well;
  7. Sign the document and ask the buyer to sign it, too.

Give one copy to the buyer and keep the other one for your records. The document will provide you with the information necessary to report the sale of your firearm to the Massachusetts Department of Criminal Justice Information Services Firearms Records Bureau. Remember that both you and the buyer must report the firearm transfer through the Massachusetts Gun Transaction Portal separately.

Does a Firearm Bill of Sale Have to Be Notarized in Massachusetts?

Massachusetts does not require a notary public's certification for gun sales but it is generally a good idea to have a notary or witness to a sale in order to confirm the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
