CONFIDENTIALITY AGREEMENT
THIS AGREEMENT APPLIES TO THE PARTIES, CHAIRPERSON,
SOLICITOR AND ANY SUPERVISING OR SUPPORTING PERSONS
1. We agree that anything said, done or written by the Chairperson,
Barristers, Solicitors and all the parties present during the Conference
is:-
a) Confidential, and on a without prejudice basis; and
b) cannot be disclosed in Court or Arbitration proceedings.
2. We agree that the only exceptions to the confidentiality of the
Conference are the following:-
a) Information that the child representative is required to disclose
regarding the welfare of the child/children.
b) Information which a Chairperson may disclose pursuant to Section
10H(2)–(6).
c) Information that cannot be protected as it involves illegal or
fraudulent acts.
d) Information directly relevant to alleged unethical conduct by a
Barrister, Solicitor or other professional person involved in
Conferences.
e) That the parties have both agreed may be disclosed by the
chairperson.
f) the written record of the agreement reached at the end of the
Conferences and signed by the parties.
g) Information that is required to be supplied by the Chairperson to the
Legal Services Commission to determine the legally aided
person/persons continuing eligibility for legal aid.

3. We agree that any notes or recommendations made by the
Chairpersons are to remain the property of the Legal Services
Commission and will not be released to the parties, their legal
representatives or to a Court.
4. We acknowledge that we do not require the Chairperson or any Legal
Services Commission of South Australia staff member, to give
evidence or produce documents about the conference in any legal
proceedings.
