What Is TR1 Form Used For?

Draft Form TR1 if you and your counterpart are working on a transaction with the intention to transfer legal ownership of certain property from one private party to the other. Only complete this document if you are transferring all items covered by the title - do not submit this form if just several items listed in the title will belong to the purchaser or beneficiary. Even if you are planning to gift your property to an individual close to you, your family member, or a friend, you need to finalize this transfer officially by submitting this document to amend current records of the Land Registry. Additionally, you may outline the details of the transfer if there are multiple parties on each side of the deed or you are signing a deed on behalf of the domestic or foreign business

How to Fill In TR1 Form?

  1. Enter the number you see on the title. There may be several numbers if you list several titles. If you have not filed any documents to register the property before, do not write anything here.
  2. Indicate the property address or provide an equivalent description to make it easily recognizable
  3. Write down the date when the transfer was executed - do not record this date in advance.
  4. Provide full names of all parties involved in the transaction - there might be multiple transferors and transferees. If any of the parties is a business incorporated in the United Kingdom, you need to add more details (the registered number of the business and the territory of incorporation if the firm is conducting its business abroad). Also, one or more parties may appoint an executor who will represent their interests while finalizing the transfer. In this scenario, the executor must submit an authorization signed by the party in question.
  5. State the transferee's mailing address. Note that this address must be relevant since the transferee might receive further correspondence and important notifications that will affect their interests and rights regarding the property.
  6. Write down the amount of money that was paid for the transferred property. Tick the appropriate box if the property was transferred as a gift. If no money changed hands, you may list the details of the transfer in the provided space and in the comment section below.
  7. Confirm the transferor has issued a guarantee for the title. You may select a full or limited guarantee - the former confirms there are no hindrances and third party interests on the property, while the latter can be used when the transferor is prepared to confirm they have not incurred any financial charges or third party interests during their ownership.
  8. If the transaction involves multiple transferees, the application must be examined and signed by joint owners who confirm they are prepared to act as joint tenants and hold the property on trust.
  9. If parties have negotiated additional provisions or they wish to elaborate on statements already provided in the form, they can do it in a separate panel.
  10. Execute the deed. The transferor must indicate their full name and sign the document. Find an individual who knows the transferor well - the TR1 Form witness must be present when you sign the document. They also have to sign the form, add their full name and mailing address.

How Long Does it Take to Process TR1 Form?

Once you have prepared the necessary documentation, mail it to the HM Land Registry Citizen Centre, PO Box 74, Gloucester, GL14 9BB. Do not forget to attach the correct fee in the form of a cheque or postal order - the TR1 Form fee differs based on the value of the property and the purpose of the application (the fee is reduced in case the property has not been registered in the past).

The transfer will be completed within ten working days or longer - it depends on the current workload the Land Registry has to deal with. If you have not received confirmation of the completed transfer within a reasonable time, you may contact the department to ask about the application.
