Farm retail outlet or supplier; 2) Agri-chemical; 3) Custom harvester; or 4) Livestock feeder and will operate within a 150
mile radius of this employer’s address. The employee will operate a vehicle of one of the following classes: 1) Class B –
defined as a vehicle weighing more than 26,000 towing less than 10,000 pounds; 2) Class C – defined as a vehicle
weighing 26,000 pounds or less. The employee will not operate vehicles carrying any placarded quantities of hazardous
materials, except for diesel fuel in quantities of 1,000 gallons or less; liquid fertilizers (i.e. plant nutrients) in vehicles or
implements of husbandry with total capacities of 3,000 gallons or less; and solid fertilizers (i.e. solid plant nutrients that

QUALIFICATIONS FOR ELIGIBILITY FOR COMMERCIAL DRIVERS LICENSE FARM WAIVER
Farm related industries are:
Farm retail outlets and suppliers
Agri-chemical business
Custom harvesters
Livestock feeders
The restrictions which, in effect, substitute for the Commercial Drivers License knowledge and skills tests are as follows:
1) Applicants must have a good driving record in accordance with 49 CFR 383.77. Drivers who have not held
any motor vehicle license for at least one year will not be eligible for this waiver. Drivers who have between
one and two years experience must demonstrate the good driving record requirements for their entire driving
history. Drivers with more than two years of driving experience must meet the good driving record
requirements for the two most recent years.
2) Restricted Commercial Drivers Licenses will have the same renewal cycle as an unrestricted CDL, but must
be limited to the seasonal period as defined by State of licensure provided the total number of calendar days in
any 12 month period for which the restricted CDL is valid does not exceed 180. The good driving record
requirement must be confirmed prior to any renewal or revalidation.
3) Restricted CDL holders are limited to operating Group B and C vehicles, as described in 49 CFR 383.
4) Restricted CDL holders may not drive vehicles carrying any placarded quantities of hazardous materials,
except for diesel fuel in quantities of 1,000 gallons or less; liquid fertilizers (i.e. plant nutrients) in vehicles or
implements of husbandry with total capacities of 3,000 gallons or less; and solid fertilizers (i.e. solid plant
nutrients) that are not transported with organic substances.
5) Restricted CDL holders may not operate a commercial motor vehicle beyond 150 miles from the place of
business or the farm currently being served.
