PERMIT TO PROPAGATE AND SELL CERTAIN RAPTORS IN VIRGINIA
PERMIT CONDITIONS
PERMIT INFORMATION
Pursuant to 4 VAC 15-30-10 it shall be unlawful to import, export, buy, sell, offer for sale, or liberate within the
Commonwealth any wild animal unless otherwise specifically permitted by law or regulation. Under authority of
§ 29.1-103 (11) and § 29.1-412 of the Code of Virginia, the Propagate and Sell Permit shall authorize the holder
to possess, propagate, buy, and sell certain wildlife.
A state raptor propagation permit shall be required before any person may take, possess, transport, import,
purchase, barter, or offer to sell, purchase, or barter any native or naturalized raptor, raptor egg, or raptor semen
for propagation purposes. An applicant must hold a current Federal Raptor Propagation Permit.
An applicant for a permit to propagate raptors required pursuant to §§ 29.1-412, 521, and 542 of the Code of
Virginia, under regulations developed under authority § 29.1-413, for a fee authorized pursuant to § 29.1-417 and
established in 4 VAC 15-20-200 of the Virginia Administrative Code, and under penalties prescribed in § 29.1-
505, Code of Virginia and 4 VAC 15-290-130, Virginia Administrative Code, shall submit to the Department a
completed Propagation Permit application form and shall conduct their propagation activities in accordance with
these permit conditions established under the authority of the Director as granted in 4 VAC 15-30-5 of the Virginia
Administrative Code.

Application: Application for a permit and an application fee shall be submitted to the Virginia Department
of Wildlife Resources, Permits Section, P. O. Box 3337, Henrico, VA 23228. (All checks made payable
to the "Treasurer of Virginia.")

Term of Permit: Permits issued under the provisions of this section shall be issued on a calendar basis
beginning January 1 and expiring December 31 for a three-year term. At $12.50 per year, the non-
refundable permit application fee is $37.50 for the three-year term. All permits, regardless of issuance
date, will expire December 31st. It shall be the responsibility of the permittee to initiate any and all
renewals.

Reports: Permittees shall remit a copy of their U.S. Fish and Wildlife Service Raptor Propagation Permit

Annual Report to the Department by January 31
of each year.
PERMIT CONDITIONS
A. No native or naturalized raptors, raptor eggs, or raptor semen may be taken from the wild unless authorized in
writing by the Department. If authorized, the raptors taken or hatched must be marked with permanent non-
reusable, numbered bands issued by the USFWS. A permittee may not purchase, sell or barter any raptor eggs,
any raptors taken from the wild, any raptor semen collected from the wild, or any raptors hatched from eggs taken
from the wild. No raptors may be intentionally released to the wild without written authorization by the
Department.
B. Raptors listed as "endangered'' or "threatened'' per 4 VAC 15-20-130 may only be possessed for raptor
propagation purposes if the raptors are captive-bred and banded with a seamless numbered band or if they are

pre-act birds identified with markers supplied by the USFWS.
C. No bird banded with a standard Federal migratory bird band may be taken from the wild for propagation
purposes.
D. Prior to issuance of a new raptor propagation permit, the applicant’s raptor propagation facilities must be
inspected and approved by a representative of the Department. Facilities must be open to inspection at any
reasonable time by an authorized representative of the Department. Permittee will inform the Permits Section in
writing within thirty days if the raptor propagation facilities are relocated.
E. The permittee shall submit the blue copy of the 3-186A - Migratory Bird Acquisition /Disposition Report to
the Department within five (5) calendar days of any transfer.
F. If the permittee wishes to add additional species to the list of species shown on their permit during the year,
authorization is required from the Department's Permits Section prior to acquisition.
G. A Permit To Exhibit Wild Animals in Virginia is not required for an authorized falconer or raptor propagator
to exhibit a bird held under his/her valid falconry or raptor propagation permit(s) for noncommercial, conservation
education purposes, except eagles.
H. 4 VAC 15-290-130 of the Virginia Administrative Code states that a permit holder shall comply with all terms
and conditions of any permit issued by the Department of Wildlife Resources pursuant to Title 29.1 of the Code
of Virginia and the regulations of the board pertaining to hunting, fishing, trapping, attempting to take, possession,
sale, offering for sale, transporting or causing to be transported, importing or exporting, propagating, exhibiting,
and rehabilitating of any wild bird, wild animal or fish. The penalty for violation of this section is a Class 3
misdemeanor unless another penalty is specified. The Department may revoke or suspend a permit for failure to
comply with the conditions of this permit. Any person whose permit is revoked or suspended may appeal that
decision in writing, to the Executive Director, Virginia Department of Wildlife Resources, P. O. Box 3337
Henrico, VA 23228.
I. This permit does not absolve the permittee of any responsibilities or conditions of any other federal, state, or
local laws and regulations, including those that apply to Threatened or Endangered (T&E) Species.
J. 4 VAC 15-30-7 of the Virginia Administrative Code requires that provided that the issuance of a permit renewal
has been delayed past the expiration date of the permittee’s previous permit at no fault of the applicant, the
permittee may continue the specific activities authorized by the expired permit until the Department has acted on
such person’s application for renewal. To qualify for this allowance, applicants must submit a completed renewal
application to the Department at least thirty (30) days prior to the expiration date of the permit. The Department
may deny renewal of a permit to any applicant who fails to meet the issuance criteria set forth by the Department.
