Reasons for Disqualification under KRS 26A.015(2)
(a)
Personal bias/prejudice concerning a party/personal knowledge of disputed evidentiary facts/expressed an opinion
concerning the merits of the proceeding;
(b)
Having served as a lawyer/rendered a legal opinion in the matter or a prior associate or partner served during such
association as a lawyer concerning the matter in controversy, or any of you has been a material witness concerning
the matter;
(c)
Judge, individually or as a fiduciary, or spouse/minor child residing in his household, has a pecuniary or proprietary
interest in the subject matter or in a party to the proceeding;
(d)
Judge/spouse/someone within the third degree of relationship to either or the spouse of such a person:
(1)
is a party to the proceeding, or an officer, director, or trustee of a party;
(2)
is acting as a lawyer in the proceeding and the disqualification is not waived by stipulation of counsel in
the proceeding filed;
(3)
is known to have an interest that could be substantially affected by the outcome of the proceeding;
(4)
is likely to be a material witness in the proceeding;
(e)
Knowledge of any other circumstances in which impartiality might reasonably be questioned.
