AUTHORITY AND WAIVER FOR PLEA DISCUSSION CONFERENCE
PURSUANT TO SUPREME COURT RULE 402(d)
I, THE UNDERSIGNED DEFENDANT in the above case, request through my attorney with the agreement of the
prosecutor, that the trial judge participate in plea discussions concerning my case.
I have been advised and understand that:
1) My attorney has requested that the trial judge participate in a conference to determine whether or not the
charges which are pending against me can be resolved by a plea of guilty.
2) During the course of the conference the prosecutor will be present and advise the judge of facts as contained
in police reports or conversations with witnesses, and my attorney will also be present and advise the judge of any
information concerning the circumstances which led to my arrest.
3) Without the conference, the judge would not learn about this information unless the case proceeded to trial.
4) The judge will also learn information concerning my prior criminal history, past driving record, any alcohol or
drug problems, work history, family situation, or other things which would bear on what, if any, punishment should be
imposed on me if I plead guilty to one or more of these charges.
5) If the conference were not held, the judge would not learn of this information unless my case proceeded to
trial, or unless I was found guilty.
6) At the end of the conference, the judge may make a recommendation as to what an appropriate sentence
would be.
7) Both the prosecutor and I are free to accept or reject the judge’s recommendations and have a trial. However,
if the judge’s recommendations are rejected by either the prosecution or myself, and I wish to have a trial, I may not
obtain another judge solely on the basis that the judge participated in the conference and is now aware of the facts
and circumstances surrounding the incident as well as my background. I waive my right to request a different judge
based upon the judge’s knowledge of my case.
I have read the above, understand it, agree with it, and wish my attorney and the prosecutor to participate in the
plea discussion conference.
