When to File I-751 Form?

If you file the petition jointly with your spouse, do it during the 90-day period before your conditional residence expires. It is possible to file the form without your spouse if they are deceased, you are divorced, or you or your conditional resident child was subjected to extreme cruelty. In this case, you may file a petition at any time after you have obtained conditional resident status.

Once you submit the form, you will have to wait for about 12-18 months - the average I-751 processing time. In some cases, the USCIS will request more information or evidence to support the petition or even ask you to appear for an interview.

How to Fill Out Form I-751?

Form I-751 instructions are as follows:

  1. Provide your personal information - full name, other names you have used, date and place of birth, country of citizenship or nationality, alien registration number, and social security number. State your current marital status, the date, and place of marriage. Add your mailing and physical addresses.
  2. Record your biographic information (ethnicity, race, height, weight, eye color, and hair color). Indicate the basis for the petition. You may submit an individual filing request.
  3. Add information about your spouse (your full name, date of birth, social security number, and physical address). If filing as a child, provide the same details about the stepparent.
  4. State personal details on all of your children (their full names, dates of birth, physical addresses). If the child lives or applies with you, check the appropriate box.
  5. If you need accommodation for yourself, your spouse, or children because of a disability or impairment, you may request it by selecting the applicable boxes.
  6. Certify that you have read and understood every instruction and question on the petition, acknowledge the possible appointment at the USCIS to confirm the information in the petition is complete and true. Add your telephone numbers and email address, sign and date the form.
  7. If your spouse files with you, the same acknowledgment and signature are required.
  8. If the interpreter or preparer helped the petitioner to answer the questions in the form, their certification and signatures are mandatory.
