Manufactured Home Notice of Security Interest
IMPORTANT: READ BEFORE YOU COMPLETE THIS FORM
Minnesota Statutes, Section 168A.141, requires that the certificate of title to a manufactured
home be surrendered to the Department of Public Safety if the manufactured home is affixed to
real property and is financed by a mortgage. “Affixed to real property” means that the
manufactured home is secured to a permanent foundation on land that is owned by the
homeowner/borrower.
In some circumstances a manufactured home may be encumbered by a security interest (a chattel
lien) as well as by a mortgage covering both the home and the land upon which it is located. In
these circumstances, the title need not be surrendered if the attached form, Manufactured Home
Notice of Security Interest, is completed and recorded with the county recorder or registrar of
titles for the county in which the real property on which the manufactured home is located.
COMPLETING THE NOTICE OF SECURITY INTEREST
Instructions for the Owner/Lender:
1. Date: Fill in the date on which the Manufactured Home Notice of Security Interest was
prepared.
2. I/We: Fill in the full name(s) of the owner(s) of the manufactured home
3. Identification/Serial Number: Fill in the identification or serial number of the manufactured
home, as shown on the title.
4. Secured Party(ies): Fill in the name(s) and address(es) of the secured party(ies) as shown on
the title.
5. Exhibit A: Attach a copy of the title behind the page labeled “Exhibit A.”
6. Exhibit B: Attach a copy of the legal description of the real property to which the
manufactured home is being affixed behind the page labeled “Exhibit B.” The legal
description can be found on the deed by which you took title, the mortgage, the attorney’s
opinion of title, the commitment for title insurance, or the title insurance policy. Do not rely
on your tax statement for the legal description.
7. Signature: All owners must sign the form.
8. Drafted By: Insert the name and address of the individual/company completing the form.
9. Return To: Insert the name and address of the individual/company to which the Notice of
Security Interest should be sent after recording by the county recorder or registrar of titles.
IMPORTANT NOTICE
1. You must record the original Manufactured Home Notice of Security Interest with the county
recorder or registrar of titles for the county in which the real property on which the
manufactured home is located.
2. When the security interest is released, you must file a notice of release or satisfaction with the
county recorder or registrar of titles for the county in which the real property on which the
manufactured home is located.
