A New Jersey Living Will - sometimes confused with an Advance Directive - is a document that allows an individual to clarify their wishes regarding health care and treatment in case of temporary or permanent incapacity.

The form must at the very least address the three following topics:

  • The election of an agent or a healthcare proxy;
  • Life support;
  • Palliative care.

A New Jersey Living Will is defined by Section 26:2H-53 of the law, Title 26 (Health and Vital Statistics) . The document must be signed in the presence of two (2) witnesses who shall attest that declarant is of sound mind at the time of signing.

What Is a New Jersey Living Will?

A Living Will is a legal document that specifies the type of medical care that an individual does or does not want in the event if they are unable to communicate their wishes.
