NONCOAL NOTICE OF INTENT TO EXPLORE (DRILLING ONLY) INSTRUCTIONS
Any person who intends to conduct noncoal exploration by drilling boreholes or coreholes in the area to be explored shall, prior
to conducting the exploration, file with the Department their written notice of intention to explore for each exploration area on this
form.
Exploration by drilling, may proceed 10 days after the Notice of Intent to Explore form is filed with the Department unless
otherwise notified by the Department. Noncoal exploration activities must be conducted in accordance with 25 Pa. Code Section
77.109.
Any person who intends to conduct noncoal exploration activities in which noncoal minerals will be removed other than from
boreholes or coreholes (i.e. test pit/trench/excavation) shall obtain a Noncoal Surface Mining Permit unless the Department
grants a permit waiver to remove the minerals for the purpose of testing and analysis of resource properties. There is another
form (5600-FM-MR0152, Noncoal Exploration Request for Permit Waiver) available for this purpose.
If the Notice is considered confidential, attach a cover sheet entitled “CONFIDENTIAL” and list the reason(s) why the notice
should not be public information. The Department will determine if the notice is confidential after reviewing the information
submitted. Information requested to be held as confidential will not be made available to the public until an opportunity to be
heard is afforded to both persons seeking and opposing disclosure of the information. This form has been developed to provide
for completeness and uniformity in the submission of information supporting the filing of a notice of intent to explore for noncoal.
The notice must be filed with the Department prior to conducting the exploration activities.
One original and one copy of the notice (including the map) should be prepared and submitted to the appropriate District Office
of the Department before exploration begins. The notice should be filed at least 10 days before starting the operation. All
information requested on the exploration form must be provided. Incomplete notices will be returned for additional information.
