What Is N12 Form?

Form N12, Notice to End your Tenancy Because the Landlord, a Purchaser, or a Family Member Requires the Rental Unit, is a document that can be used by landlords when they want to end a tenancy due to certain reasons. The purpose of the document is to inform tenants that their landlords (or property managers that represent them) want to terminate their lease because:

  1. The unit was bought from the landlord and its new owner wants to move into the unit. It can be also applied if it is not the owner but the owner's family member, or an individual who offers professional assistance to the owner's family member.
  2. The landlord's family member (or an individual who offers professional assistance to the family member) wants to move into the unit.

The form was issued by the Social Justice Tribunals Ontario and was last revised on July 28, 2020. A fillable N12 Form is available for download below.

Form N12 Instructions

  1. Introduction. In the first part of the notice, the landlord should designate their full name, their tenant's name, and the full address of the rental property.
  2. Termination Date. Here landlords are supposed to indicate the last day of the lease. By (or on) this day the tenant is supposed to move out of the property. Otherwise, the landlord has a right to address the Landlord and Tenant Board (LTB). They will schedule a hearing during which each party can express their point of view, and the LTB will make a decision on whether the tenant will be evicted or not.
  3. Reasons for Ending Tenancy. This section of the form consists of several options from which the landlord is supposed to choose the most suitable one. It will determine the reason for ending the lease for the tenant.
  4. Information for the Tenant. This part contains N12 Form instructions developed by the LTB. They can be valuable for the tenant, especially if they do not know what their next step should be. It includes information about their rights, what should be done if they can leave the property earlier, and other matters connected with it.
  5. Signature. At the end of the document, landlords should put their signature, full name, telephone number, and the date when they have signed it.
  6. Representative Information. If the form is signed by the landlord's representative, they should designate their identifying information in the last part of the notice.

The notice can be completed and furnished only if the landlord follows particular requirements. N12 Form rules include the following:

  • The end date of the lease must be set 60 days after the tenant has received the document (it also must be set on the last day of the rental period);
  • Tenants are entitled to receive compensation or another unit that they consider acceptable from their landlord;
  • Landlords can only use this document to require the rental unit for their close family members (not extended family).

In addition to this, the notice must be completed fully without any errors, otherwise, it might be considered invalid.
