In accordance with the Montana Department of Transportation's Specification 104.05.4 MAINTENANCE FOR TRAFFIC DURING
WORK SUSPENSIONS. The following parties enter into agreement for winter maintenance for this project during winter
shutdown.
MDT Maintenance Area: The Montana Department of Transportation (MDT),
Prime Contractor:
The named MDT maintenance area agrees to provide all resources to perform snowplowing, sanding and/or deicing activities to
roadways within this project that are constructed to a crushed aggregate course surface under the following conditions:
1. MDT will be responsible for snowplowing activities on the gravel surfaced areas only during the winter season when the
gravel surface is froze to a hard plow-able surface. Prior to freeze up, or during periods of thaw when the gravel surfacing
is soft, the Prime Contractor will be responsible for any plowing needs.
2. Per Specification 104.05.4, the Prime Contractor agrees to reimburse MDT for all labor, equipment, material, and
administrative costs associated with plowing, sanding, and deicing operations during the winter shut down period.
3. Per Specification 104.05 the Prime Contractor will furnish all necessary supervision, personnel and equipment required to
maintain the road in a safe condition and at the highest level of service to the traffic.
4. The Prime Contractor is responsible for all traffic control within the project to include installation, maintenance and
cleaning of all traffic control devices. The use of portable traffic control devices will not be used for winter shut down
unless reviewed and approved by MDT's Project Manager.
5. The Prime Contractor is responsible for all roadway surface maintenance including the repair of potholes and other
surface deformations that may require patching or blade operation for roadway smoothness on the project.
6. MDT is not responsible for any repairs or maintenance to the project that results from snowplowing, sanding and/or
deicing or other operations performed by MDT.
7. Any roadway materials, i.e. CAC, Aggregate Treatment, Embankment, etc. lost due to maintenance activities will be
replaced by the Prime Contractor at no cost to MDT.
8. Upon signature of this document, the Contractor will furnish MDT with the name/s and phone number/s of the Prime
Contractor's contact person/s to be notified of any defects. Failure to begin to remedy unsatisfactory maintenance within 4
hours of notification may result in:

due to the contractor, or otherwise be billed to the Contractor.

Contract time being charged. Contract time will be charged starting on the day of the Department's initial

Will void this agreement and all maintenance will become the responsibility of the Prime Contractor.
