because of continued therapy, treatment or medication, defendant’s mental illness has abated or has come under
control so that he/she is no longer incompetent or no longer poses a real and present threat of substantial harm to himself
or herself or to others by being at large and custody and care by the Department of Mental Health (or other institution) is
no longer necessary, a hearing is scheduled for (date) __________________ at ________ ____ .m. at (location)
__________________________ to determine whether the defendant is now competent for the crime(s) charged and/or
may be released from custodial confinement.
The clerk of court is directed to mail a copy of this notice to the defendant, the defendant’s attorney, the district
attorney, the Sheriff and the facility or agency with custody of the defendant.
