The individual purchasing a house makes an agreement to work with a certain agent for a fixed amount of time at the end of which, the agent will receive a payment in the form of commission. This prevents another real estate agent from swooping in at the last minute, making a sale, and taking the commission for themselves. This leaves the real estate agent who initially did all the hard work and devoted their time, with nothing. Such agreements prevent this from happening.

All Buyers Agency Agreements will somewhat differ and may even be referred to by different names, generally the most important information that you need to take special notice of relate to:

1. Time Period. This clause outlines the time period for which the agreement will be active. Typically this is between 3-6 months.
2. Agreement Termination. Although this is a last resort, if either party is unhappy they have the right to terminate the agreement. Details on termination along with any fees for this must be clearly outlined.
3. Responsibility of the Agent.
4. Property Information.
5. Compensation Package.
6. Agent Representation. If it is exclusive, the home buyer cannot sign other agreements with other real estate agents.
