Colorado Postnuptial Agreement: What Is It?

A Colorado Postnuptial Agreement is a legal document formed between two individuals that are married and are mainly done if there is an abrupt financial change for one of the spouses. The main aim of signing the agreement is so that there will be no ambiguity when it comes to sharing possessions and properties if a situation such as a divorce or death of either spouse occurs.

All information will be detailed within the agreement which will simplify the work of the judge, leading to an overall decrease in the amount of time that the case will be looked at in court. In order for the Colorado Postnuptial Agreement to become enforced legally, you must ensure:

• All agreements must be documented in writing;
• Both spouses must place their signatures in the document;
• The parties must enter this agreement on a completely voluntary basis;
• The parties must also disclose their finances to each other. If they choose not to do so, they must agree to and sign a separate notice.

If all of the criteria above are met, the document becomes a legal contract.
