Connecticut Postnuptial Agreement: What Is It?

A Connecticut Postnuptial Agreement is a legally binding contract that is formed between spouses during the time that they are married, not before. The document acts as a formal confirmation of the way that any property obtained in marriage will be shared out in the event that one of the spouses files for dissolution of the marriage or passes away.

If either of these two events occurs and the case reaches the court, the judge can only enforce the agreement providing that:

• The agreement has to be signed and made voluntarily, not against the will of either spouse;
• There must be no external pressure from anyone to make a spouse sign this document;
• Each party of the agreement must give and also must be provided with full information concerning financial assets as well as information about the property including its true value. Full income of each spouse must also be shown and this information is absolutely critical.

The conditions have to be fair and justified. Once a judge accepts the terms, the agreement becomes a legal contract that must be enforced legally.
