Indiana Postnuptial Agreement: What Is It?

An Indiana Postnuptial Agreement is a legal document that is signed by spouses during their marriage - not before or after. The agreement serves as a formal, documented agreement concerning the way that a property will be divided in the possible event that a spouse files for divorce or passes away.

If these events are unfortunate enough to occur, the case will make its way to the appropriate court where a judge can enforce the agreement. They will do this if the criteria below are met:

• Any settlement agreements although need to be documented in writing, do not necessarily need to be signed;
• There must be no pressure to make a spouse agree to the contents of the document;
• Each spouse should provide the other spouse with information concerning their finances including information about properties. Their total income must also be shown;
• Agreements may also concern financial payments and custody of children.

The agreements included in the document should be fair. If a judge accepts the terms of the agreement, the document can be classed as a legally binding contract.
