What Is Form POS-010?

Form POS-010, Proof of Service of Summons, is an official document filled out by the individual who presented the summons to a party of a legal case in the state of California. This statement will confirm the summons was given to all the people who must be aware of the case and its development. In case the party or witness claims they did not receive the summons on time or in an appropriate manner, this document will confirm the server named in it did their duty and personally served the summons. Before you deliver the documents, you must copy the details from them to this form and then submit Form POS-010 to the court as evidence to show the party to a lawsuit or a witness has received the court papers you were entrusted with.

Form POS-010 Instructions

Here is how you are supposed to complete the POS-010 Form:

  1. Enter the name of the legal representative or the party that decided to represent themselves in the case. Add their contact details and the name of the individual or company on whose behalf the summons is delivered.
  2. Identify the court that has jurisdiction over the case by its branch, physical and mailing addresses.
  3. Name the parties to the case and record the number of the case.
  4. Confirm you were at least eighteen years of age when the summons was served and you are not participating in the action in question.
  5. Check to box to indicate the document you delivered - for instance, you may present a statement that contests the other party's claim or a package that offered to settle the dispute outside of the courtroom.
  6. Add the name and the address of the party you served. If this individual was authorized by a party to an action to obtain all case-related papers, check the box, state their name, and specify their relationship to the case participant.
  7. Describe the type of service you provided. You either personally delivered the documentation, chose to give the summons to another individual by leaving the documents at the party's workplace or home or their usual mailing address, or opted for mail delivery to obtain a tangible receipt. You may attach an additional page to outline the details of the service if necessary.
  8. Check the box to certify the summons was addressed to a defendant, occupant, or the individual sued under the fictitious name. Enter the name of the individual or entity on whose behalf you served the summons.
  9. Provide your full name, mailing address, and telephone number. Record the fee for service and check the box to verify your registered process server status if applicable.
  10. Confirm the details in the form are true and accurate, sign and date the document.
