A Virginia Last Will and Testament details how a person's possessions and property should be distributed after their death. The document has three main purposes:

The Virginia Last Will is defined by § 64.2-100 and regulated by Title 64.2 ( Wills, Trusts, and Fiduciaries ). It formulates the signing of the document in the following terms:
- The will is valid if handwritten and signed by the Testator and it must be proved by two (2) disinterested witnesses.
- If not handwritten by the Testator, the will must be signed by the Testator and two (2) witnesses in the presence of each other, including the Testator.
What Is a Last Will and Testament in Virginia?
On the whole, a Last Will and Testament allows a Testator to allocate their assets between any number of parties according to their wishes. Creating a will gives the Testator sole discretion over the distribution of their estate. If the Testator is the owner of a business or has any investments, their will can direct a smooth transition of those assets as well.
Making a will is a necessary - and, usually - a fairly simple process that can save the Testator's family time, money, and give all parties peace of mind.
How to Write a Will and Testament in Virginia?
- Describe marital status and list all children. For the purposes of a will, the Testator must note whether they are married as well as whether they have any children - both those born to the Testator and those that have been legally adopted. All children and dependents must be included even if they are not given a portion of the Testator's assets.
- Elect Beneficiaries. The most important part of the Last Will is the appointment of beneficiaries. Beneficiaries are the individuals or organizations that will inherit the Testator's estate and property.
- Appoint a representative or an executor. An Executor must be appointed by the Testator in their will. The Executor will be in charge of carrying out the Testator's wishes concerning their property and will make sure that the beneficiaries get the correct portion of their inheritance as described in the will.
