HOLD HARMLESS AGREEMENT

1)
, ( “Landowner”), together with Landowner’s employees,
subcontractors, representatives, successors and assigns, and other persons or entities acting on
the behalf of Landowner, in consideration of the applicant to the Cogongrass Treatment Cost-
Share Program, __________________________, (“Applicant”) and/or contractors hired by the
Applicant applying herbicides to cogongrass (Imperata cylindrica) infestations free of charge on
Landowner’s property located at (address or location):

(“Property”), agree, by signing of this Agreement, to release, acquit, indemnify, save and forever
hold harmless the Applicant and their agents or contractors from any and all claims, loss, damage,
injury and liability, whether for personal injury or otherwise, resulting from, arising out of, or in any
way connected with the work to be performed under this Agreement. Landowner acknowledges
that the application of herbicide is a specific benefit to Landowner.
2)
Landowner acknowledges that the initial application of the herbicide on the Property by the
Applicant will take place over two consecutive years.
3)
Landowner acknowledges that follow-up treatments may be necessary for effective control of
cogongrass infestations. Unless specifically indicated in this agreement, all follow-up treatments
after the two-year program period are the responsibility of the Landowner.
Additionally, the
Landowner acknowledges that while the intent of the treatment/s detailed in this agreement is to
control or eradicate the cogongrass infestations, the Applicant does not guarantee either, and any
necessary and additional treatments beyond the scope of this agreement are not the responsibility
of the Applicant.
4)
Landowner acknowledges and accepts that while care will be taken to reduce damage to
non-target species, non-target vegetation may be damaged or destroyed by the treatment activities
performed by the Applicant.
5)
The treatment will target cogongrass, a non-native, invasive species.
Treatment will involve the application of an appropriate herbicide solution to the above-ground
portion of the plants, plus a 10-foot buffer strip around each infestation.
