What Is Form N1?

Form N1, Claim Form , is used when you are unable to remedy a legal or monetary issue with another party and are seeking to settle the matter in court. This form is useful when you have tried to resolve an issue between two parties, but will need to use the court to settle the matter. The N1 Form can be used in instances where no criminal act has occurred, but the aid of the legal system is still needed.

Where to Send N1 Claim Form?

For all claims not related to monetary restitution, you can mail the N1 Claim Form to your local court office. If this claim does include monetary restitution, you must use the following address: County Court Money Claims Centre, PO Box 527, Salford, M5 0BY.

How to Fill Out N1 Claim Form?

Provide the following information to complete the N1 Claim Form:

  1. Include the county court name in the box titled "In the" (top right-hand corner of the first page). Include the fee account number and the reference number if you require assistance when completing the form.
  2. List all persons acting as claimants, including their full addresses. A claimant is a person seeking legal action against another party (this party is known as the defendant).
  3. Provide the name and address of the defendant you are taking action against. This can be an individual, business, or organization. If you are in a dispute with an individual, you must also include their title (such as Mr., Ms., or Dr.) and phone number where they can be reached.
  4. Explain briefly the issues that led to filing N1 Form. The goal of this section is to clearly explain why you are seeking legal action and that you were unable to resolve the matter in any other capacity. You will also include how you wish to resolve the situation (either by calling for monetary restitution or a specific action). As an example, if you are filing an N1 Form against a landlord if they have refused to fix an issue with the property you are renting from them, you can either request that the court demands the landlord make repairs to the property or agrees to award you funds that will allow you pay for the repairs.
  5. If you have decided to seek monetary recompense, you will need to include whether it is a specified or unspecified amount. A specified amount of money can be listed as either an exact amount or a range you are expecting to receive. For example, you can state the amount you are asking to be rewarded is more than £15,000 but not in excess of £30,000. If you are unsure of the total amount of money you are hoping to receive you will need to write that you are unsure of the total monetary value you are seeking to recover. If your claim is the result of an injury you have sustained to your person, you are also entitled to include a monetary amount for damages related to pain, suffering, or loss associated with the injury.
  6. State the preferred county court center where you wish your claim to be heard. If you are unsure of the location of your nearest court, you can search the Ministry of Justice's website for the nearest tribunal location.
  7. List the total amount of money you will be claiming, the total amount of N1 Form fees due for court, and any costs for legal representation, and the total amount for all three.
  8. On the second page, you will be asked if your claim is in regards to the Human Rights Act of 1998 and asked to include additional details related to the claim. In this section, you must clearly explain the details related to your claim, what laws you feel were violated by the defendant, and your reasoning for the restitution you are seeking.
  9. At the end of the form, you will sign the "Statement of Truth" that certifies that everything that has been listed in your N1 Form is factual to the best of your knowledge. Both your signature and the signature of your legal representative are required.
