Sample "Guardianship Letter in Case of Death"

A Guardianship Letter in Case of Death is a legal document prepared by the parents or legal guardians of the children who want to choose a guardian for their children if they pass away before the children reach adulthood. It is possible to name a person as a permanent guardian for the children in the last will and testament and elaborate on the choice in a separate letter especially if the parents believe the guardianship may be contested by other people, such as their family members. How to Write a Guardianship Letter in Case of Death?

You may customize a Guardianship Letter in Case of Death template to your liking. Consider adding the following details to your document:

  1. Names of all relevant parties - parents, children, and chosen guardians.
  2. Confirmation of your decision to trust your relatives or friends with raising your children in the event of your untimely death. It is a good idea to point out that the appointed guardian has experience in caring for children or they have spent a lot of time with your children and you are sure they will do well as guardians.
  3. Acknowledgment of your discussion of the guardianship with the people you chose for this role. Only name people who gladly accept this responsibility.
  4. Explanation to show why you decided not to opt for other people who might seem a better choice for guardianship - for instance, you may describe your tumultuous relationship with the closest family members who will not be a good fit for your children.
  5. List of rules and wishes you would like to be respected. For example, you might ask the future guardian to let your children see their relatives or to stay at a school they are currently enrolled in.

It is recommended to obtain a notary seal once you finish drafting a letter and sign it to make sure your wishes are respected - a notarized document is rarely disputed.

To My Family and the Executor of My Will,
The purpose of this letter is to explain my reasons for naming Ella Wilkins the
guardian of my minor children, Dominic and Carol, in the event of my death. I ask
that my family support my decision and do whatever they can to help my children
transition to their life with Ella.
If any of you disagree with my decision to name Ella as guardian, please understand I
gave careful consideration to all the issues involved in making this decision. I made
this decision based solely on the best interests of my children. If any of you are
disappointed, hurt, or offended by my choice of guardian, that was never my intention.
I was fortunate to have each of you in my life and hope you will all continue to be part
of the lives of my children.
I am confident Ella Wilkins will be an excellent guardian. She has raised three
wonderful children of her own and has spent a lot of time with Dominic and Carol.
Ella is active in our church and shares my faith. She and her husband, Luke, have a
stable home life and share my values.
I discussed my plans to name Ella as guardian with Ella and Luke at length. Ella has
also agreed to serve as caretaker of our dogs, Brownie and Rose, if the dogs survive
me. Because Ella is able to provide a home for our family pets as well, Dominic and
Carol will not have to be separated from the pets they love so much. It is very
important to me that Dominic and Carol be able to continue with as much of their
existing life as possible, including their pets, church, sports, and the activities at their
current schools in Morgan County. I have chosen Ella as their guardian so they will be
able to do that.
Ella knows both of my parents and has a good relationship with them. She
understands the importance of making sure Dominic and Carol see their grandparents
on a regular basis. Ella has spent a lot of time with my sister, Melanie, and also

understands I want Melanie to be able to visit my children whenever Melanie comes
back to Texas to visit.
My ex-husband, Carl Duncan, is not a suitable guardian for Dominic and Carol. Carl
is an alcoholic and has been unable to hold a job for several years. He has not seen the
children in three years and has never paid any child support. Carl’s parents are
deceased and my children do not have a relationship with any relatives from Carl’s
family.
Thank you for honoring my choice of guardian for my minor children. Please do what
you can to help Dominic and Carol by supporting Ella as their guardian.
Love,
Dorothy
