Gift Deed Form - Washington

A Washington Gift Deed is necessary when a person wants to donate or gift property or real estate to another party, with the understanding that the gift recipient will not be expected to pay for the gift. To avoid the deed being contested later in court, it is important to make sure all the language and agreements in the document are clear and unambiguous. When writing the gift deed, include a full description of the property, plus the chain of title and any restrictions related to the property. For all gift transfers in Washington state, a real estate excise tax affidavit will need to be completed as part of the documentation (Wash. Rev. Code 458-61A-201). The gift deed, additional materials, and any filing fees can be submitted to the local county Clerk's office.
