Gift Deed Form - South Carolina

A South Carolina Gift Deed is required to document a person donating or gifting property or real estate to another person or party, where no payment will be required during the transfer. To avoid the deed being contested later in court, it is important to make sure all the language and agreements in the document are clear and unambiguous. When completing a gift deed, a full legal description of the property must be made, in addition to a record of the chain of title and any outstanding restrictions of the property. At the time of signing the deed, two witnesses must also be present, including a person authorized by the state to confirm authenticity. To submit a gift deed, provide all documentation, plus an Affidavit of True Consideration (S.C. Code Ann. 12-24-70(A)(1)) and submit them to the local Recorder's office.
