What Is Form 945 Used For?

Federal 945 Form allows employers to provide fiscal organs with a summary of the income taxes they deducted over the course of the calendar year. Who Files Form 945?

Do not file the document if during the year that just ended you had no nonpayroll tax liability.

Form 945 Instructions

Here are the Form 945 Instructions for employers to use:

  1. List the details of your entity - its legal name, trade name, mailing address, and employer identification number. Check the box if you need to confirm an address change that took place since you filed a previous return.

  2. Let the IRS know you will end your operations which means the statement you are filling out is the final one - check the appropriate box and add the date when the final tax payment was carried out.

  3. Indicate the amount of income tax deducted from all nonpayroll payments, specify how much tax was automatically deducted at a 24% rate, and combine the two numbers - the result you get has to match the tax liability for the year you outline in writing.

  4. State the amount of deposits you have made during the year, record the balance due, and enter the difference between the amount of deposits and the amount of taxes if necessary. If there was an overpayment, you can choose between requesting a refund or applying these calculations to the future return.

  5. Check the box that describes your deposit schedule - either you will have to complete IRS Form 945-A, Annual Record of Federal Tax Liability, or proceed to the next section of the form. In the latter case, provide information about your monthly tax liability.

  6. Give a third party authorization to speak on your behalf with tax organs discussing the details of the return. Certify the document - you have to identify yourself, sign and date the papers. If you were assisted by a tax professional, they must list their details too.

  7. Fill out a payment voucher if you do not pay your taxes with the help of a debit card, credit card, or Electronic Federal Tax Payment System. When Is Form 945 Due?

Make sure you do not miss the Form 945 due date - January 31 that follows the year described in the document. There is a different deadline for depositors who were able to deal with deposits without any delays and fully pay their taxes for the tax period in question - they are permitted to file the form by February 12. Whether you fail to make deposits in accordance with the regulations or submit the papers on time, you will be subject to Form 945 penalties - they are often imposed on all individuals who were expected to collect the information and pay the taxes.

If you operate in Alabama, Alaska, Arizona, Arkansas, California, Colorado, Florida, Hawaii, Idaho, Iowa, Kansas, Louisiana, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota, Oklahoma, Oregon, South Dakota, Texas, Utah, Washington, or Wyoming, mail the document to the Department of the Treasury, IRS, Ogden, UT 84201-0042. Employers that enclose a payment with the form must use a different address - IRS, P.O. Box 932300, Louisville, KY 40293-2300.

  2. Connecticut, Delaware, District of Columbia, Georgia, Illinois, Indiana, Kentucky, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Vermont, Virginia, West Virginia, and Wisconsin employers need to file the return with the Department of the Treasury, IRS, Kansas City, MO 64999-0042. If the payment is a part of the package, the address is IRS, P.O. Box 806534, Cincinnati, OH 45280-6534.

  3. Employers that do not have a main place of business in any of the states have to submit the paperwork to the Department of the Treasury, IRS, P.O. Box 409101, Ogden, UT 84409. Alternatively, forms with payments attached to them will be processed by the IRS, P.O. Box 932300, Louisville, KY 40293-2300.

  4. In case you represent a governmental entity or tax-exempt organization, the address you are supposed to use is Department of the Treasury, IRS, Ogden, UT 84201-0042 (IRS, P.O. Box 932300, Louisville, KY 40293-2300 if you prepared a check or money order).
