Form 5049, Notice of Sale or Transfer is a document used to inform the Department of Revenue that you have sold or transferred ownership of a vehicle. This legal notice demonstrates the agreement of the parties, protects the seller and the purchaser in case any disputes or disagreements occur after the sale takes place, and proves the sufficient payment was made. Missouri Form 5049 requires the following details:

  1. Purchaser's full name, signature, address, driver license number, and date of birth;
  2. Description of the vehicle. Select the type of the vehicle in question, provide the sale date, write down the net price, title number, year, make, and vehicle identification number;
  3. Seller's full name, address, and dealer number (if applicable). The seller must certify the facts and conditions mentioned in the document are true and accurate.

Notice of Sale Vs. Bill of Sale (Missouri)

Form 1957, Bill of Sale or Even-Trade Bill of Sale, is the main document used when selling a vehicle in Missouri. However, Form 5049 can be used as a bill of sale for a vehicle in Missouri in several instances:

  1. When you need to get a temporary permit;
  2. When you require a 180-day replacement - a newly purchased vehicle;
  3. When you receive a subsequent vehicle sales tax credit;
  4. When you substantiate the purchase price of the unit.

Since 2006, the seller of the motor vehicle, trailer, or all-terrain vehicle must report their sale within a month of the date of the sale to the Department of Revenue. Once you complete the required sections of the notice, mail the form to the Motor Vehicle Bureau, P.O. Box 3050, Jefferson City, MO 65105-3050. Keep a copy of the document for your records. If you fail to submit the notice, you will be subject to a fine of up to $200.

You must report the sale because if the vehicle purchaser does not apply for a title within two months of purchase, the Department of Revenue will notify the new owner of their obligation to obtain a title and the amount of due taxes, fees, and penalties. Until the buyer gets a title, the seller remains the last titled owner of the vehicle on record.
