Special Warranty Deed Form - New Jersey

To document a transfer of real property you can use a New Jersey Special Warranty Deed. According to section 46:4-8 of the New Jersey Statutes, words of the deed that the grantor "will warrant specially the property hereby conveyed" mean that the grantor had covenanted that he (also his heirs and personal representatives), will forever warrant and defend the real property designated in the deed to the grantee against any claims and demands made by, through, or under the grantor. In compliance with a short form deed, a special warranty deed shall include the name of the grantor, the name of the grantee, the description of the real property, the amount of the consideration paid, and words that the grantor conveys the real property "with special warranty" (46:4-1; 46:4-9).
