Special Warranty Deed Form - Massachusetts

A Massachusetts Special Warranty Deed is an instrument of conveyance of a real property that protects the grantee only from defects of title during their ownership. There are no warranties of title for any encumbrances beyond the granter's ownership. In this state, a special warranty deed shall be acknowledged before a justice of the peace, a notary public, or another authorized officer listed in Section 30 (Title I, Chapter 183) of the Massachusetts General Laws. To make sure your deed will be recorded in the registry of deeds (Title VI, Chapter 36, Section 12), don't forget to include in it such elements as the name, residence, and the postal address of the grantee, and the amount of the consideration paid (Title VI, Chapter 36, Section 6).
