If an individual or an entity would like to sell their real property they can use a South Dakota Special Warranty Deed . This type of deed implies that there are no outstanding claims arising from the ownership of the current grantor, however, it does not guarantee that there are no issues that could be a result of the actions of previous owners. Following the provisions of the South Dakota Codified Laws, your special warranty deed shall be executed in writing and signed by the grantor or their agent authorized by writing (43-25-1). Make sure your deed is acknowledged and recorded in accordance with Chapter 43-28 of the laws (Recording of Instruments).
