How to Write a 5-Day Eviction Notice?

Follow these steps to prepare a 5-Day Eviction Notice Form:

  1. Greet the letter recipient by their name. It is possible the tenant lives with their family or roommates - in this case, you should refer to them by their names as well.
  2. Indicate the legal address of the property to be vacated.
  3. Include the reference to the Lease Agreement you have signed with the tenant. Following the conditions of the contract, you are entitled to inform the tenant about your decision not to continue the contractual relationship and ask them to leave the real estate within five days.
  4. Since this eviction is typically used as the last warning, you should list the options of the tenant who can still rectify the negative situation they created. You can request them to pay the remainder of the rent, fix the violation of the agreement (for instance, they were noisy and did not let their neighbors enjoy the residential unit in peace), or demand them to leave the premises since they were engaged in illegal activity.
  5. Certify your intention to take further steps, including filing a lawsuit, if the tenant refuses to comply with the terms you have outlined in the notice. State your name, sign and date the document.
  6. Draft a short certificate of service. Confirm you personally delivered the notice to the tenant, left the letter with their household member or colleague, or mailed the documentation to the tenant. Add the date of service, write down your name, and sign the papers. You can warn the tenant about the letter they are about to receive via a phone call - however, it is up to you.
