Form VR-181, Vehicle Bill of Sale is a legally binding agreement signed between a seller and a buyer in order to document a car transfer. The form is a part of the required documentation a buyer has to provide during vehicle registration. This document is required to establish the purchase price if the Maryland Certificate of Title does not provide space for it. It contains a description of the sold car, names of all parties of the transfer (all sellers and buyers involved), and basic details of the deal. This form is an official document and all statements made must be true and correct. Entering false information is a misdemeanor that can lead to a fine of up to $500 or imprisonment for up to 2 months.

Selling a Vehicle in Maryland

Selling a vehicle through private sales in Maryland, the first thing you need to take care of is the car safety inspection. The inspection can be conducted by any dealer, automobile service center, or service station that is licensed as an inspection station by the State of Maryland. After the inspection, you will receive a Maryland Safety Inspection Certificate that is valid for 90 days.

After you and the buyer have agreed upon the price and terms of the sale, complete the Assignment of Ownership section on your Maryland Certificate of Title. If the document is lost or destroyed, apply for a duplicate title before selling the car. The application can be made online, in person, or by mailing Form VR-018, Application for Duplicate Certificate of Title.

Fill out the form. It is necessary to establish the price you agreed upon and to determine the amount of taxes. A properly completed Form VR-181 requires the following information:

  1. Full description of the vehicle, including the year, make, model, body style, and Vehicle Identification number;
  2. Names of all buyers and sellers;
  3. Sales amount;
  4. If the sales amount is lower than the fair market value, the reason must be explained in the document;
  5. Odometer reading;
  6. Signatures of all sellers and buyers and the dates.

You also have to provide a Notice of Security Interest Filing to prove the car you sell is paid off. If this document is not available, ask a financial institution to provide you with a letter, informing that they hold no security interest (release of lien) on the car you sell. Do not forget to take the license plates off the sold vehicle and to cancel the insurance. If you do not transfer the license plates to another car, return them to the Maryland Motor Vehicle Administration.

Does a Vehicle Bill of Sale Have to Be Notarized in Maryland?

Yes, to be valid, a Vehicle Bill of Sale must be notarized in Maryland. The VR-181 Form provides space for two notary public's certifications. The second space must be used if any party to the transaction was not present at the initial notarization. It is not obligatory to have two notaries to sign the document if one satisfies both parties.
