Car Accident Liability Release Form

What Is a Car Accident Liability Release Form?

A Car Accident Liability Release Form is a document confirming that an agreement has been met and settled not within the system of law.

Alternate Names:

  • Car Accident Release;
  • Car Accident Release of Liability Form.

This is useful for events where a car accident has occurred and the involved parties may want to resolve this issue independently without involving the courts. By signing the document, it acts as confirmation that an agreement was reached and it acts as a safeguarding measure by ensuring that one of the parties does not open up a legal battle against the other party after the issue has been settled.

These kinds of forms do not only cover damages to the car but also include any injuries to the driver(s) or passenger(s). If the parties involved manage to find a way out without involving the court which can sometimes be expensive (depending on your insurance cover) and quite lengthy, they must sign this form for peace of mind.

How to Create a Car Accident Release of Liability?

Creating a Car Accident Release of Liability Form is very straightforward. The key in this document is attention to detail. Once an accident has occurred and you have reached a decision, follow the structure below when creating your form:

  • Get as much information as you can straight after the accident has occurred. This should include details about all of the involved parties (their names, make and model of the vehicles along with registration plates);
  • If the police were invited to the scene of the accident, they will usually fill in a protocol and take photographs. The protocol will also detail which party was at fault. Copies of all of this information should be retained;
  • Include the name of the person (known as the Releasor) who by signing, confirms that they accept the fact that they will not be able to open up a legal claim against the other party in regards to the accident;
  • Include the name of the person (known as the Releasee) who was at fault in the accident. This is the person that will be required to make the agreed payments;
  • Provide a brief summary of the accident and include a conclusion about the party at fault of the accident. Make sure to provide details regarding the date, time and location of the accident;
  • Write down the amount that the releasee obliges themselves to pay the releasor. This sum must be agreed by both parties.
