Who Is Required to File Form I-765WS?

File an I-765 Worksheet if you fall under one of these immigration categories:

  1. Deferred Action. An immigration status that can indefinitely delay deportation. You must file Form I-765 with a copy of the notice, order, or another document that reflects the deferred action and proves you have an economic necessity to work. Your current annual income, expenses, and the total current value of your assets will be reviewed after you provide this financial information on the I-765WS Form.
  2. Deferred Action for Childhood Arrivals (DACA). An immigration policy that lets certain individuals who have been brought to the U.S. as children receive deferred action from deportation and be eligible for a work permit. If you belong to this category, file Form I-765 with Form I-821D, Consideration of Deferred Action for Childhood Arrivals. Add the Worksheet to demonstrate the economic necessity to work.

How to Fill Out Form I-765WS?

Form I-765WS instructions are as follows:

  1. Write down your full name.
  2. Indicate your financial details (your current annual income, expenses, and the total current value of your assets).
  3. Provide an explanation regarding your financial situation using the rest of the page. This is an optional field - the USCIS will have to determine whether you have an economic need to warrant the issuance of the EAD. You do not have to prove that you are going into poverty - simply demonstrate that you have a need. Even if your income is greater than expenses, you may need to work for various reasons - you are saving for a car or an emergency healthcare fund, you would like to contribute toward your own costs while your parents provide for most of your expenses, or you want to save for college. Describe your particular situation in your own words.

The worksheet is relatively short - you have to provide most of the information in the main document, Form I-765. There is no need to add any evidence or supporting documents, but the USCIS will accept and review the documentation you choose to attach to the application and worksheet. The form only requires your financial details - do not include other household members' financial information, only your own economic necessity must be established.

Once you complete the application and worksheet, you may fill outForm G-1145, E-Notification of Application/Petition Acceptance, to request an electronic notification when the USCIS accepts your documentation. Complete the request and clip it to the first page of your documentation package. There will be one email and/or text message for each document you have submitted.
