What Is an Affidavit of Service?

An Affidavit of Service is a legal document that contains a written statement of the individual. It can be used for two different purposes:

  1. You need to confirm the successful delivery of documentation to someone, for instance, when you submit papers to the court for your trial. A statement like this can also be called an Affidavit of Service by mail. You may deliver any documents or belongings and sign an affidavit to have evidence of service.
  2. You need to verify your or another individual's active duty for a court case, lender, or debt collector. It protects people who serve in the military and did not receive a lawful notice first so that they get a chance to protect themselves in court.

What Is an Affidavit of Non-Military Service?

Whether you are facing a foreclosure, real property eviction, or have to defend your interests in the child support case, you might need an Affidavit of Non-Military Service. It can be signed by you or a person who has first-hand knowledge about your life and can confirm that right now you are not in the military service, whether or not you had such an experience in your past. It is useful when an individual does not appear in court and the court seeks to protect the rights of service members who cannot possibly make a formal appearance in court while, for example, serving overseas. A properly filled out declaration of non-military service will move the case forward.

How to Fill Out an Affidavit of Service?

A Service Affidavit signed by the person who delivers the documents to individuals involved in a trial, court clerk, and various institutions should include the following details:

  • Name of the individual or entity who receives the papers;
  • Date and location where the responding receives the documentation;
  • List of documents served;
  • Name and signature of the server.

When you complete the affidavit, sign it in the presence of a notary public and present or mail it to the individual or company that is being sued or to the court clerk. If for some reason you were not able to send the documents to the intended addressee, there is an option to file an Affidavit of Non-Service. This form must explain why you could not send the information, and you may ask for another chance to fulfill your obligation.

If you need to verify your military status or the military status of another person in case you have personal knowledge about it, follow these steps:

  1. Enter the name and address of the respondent.
  2. Identify yourself and write down your title, grade, or rank if necessary.
  3. Name the individual in question and confirm they are on active military. Indicate the period of service. You may also attach proof - add the titles of necessary documentation in the affidavit.
  4. Sign and date the form. Notarize it and give it to the requester.
