New Jersey Small Estate Affidavit Form: What Is It?

A New Jersey Small Estate Affidavit Form legally allows for an individual to collect a property that they have legally inherited from the decedent (an individual that has passed away). The main advantage of using a New Jersey Small Estate Affidavit is that it removes the long and tedious probate period in court which would otherwise take up a rather large amount of time.

In New Jersey however, the filing process of this document has several laws attached to it that should be taken into account rather seriously before even thinking about filling in the form. If this is not carried out, the document cannot be recognized on a legal level. This is why we have created a list of all important laws concerning those individuals residing in New Jersey:

• Although there is no minimal amount of days that you have to wait before filing the document in the state, some counties may have such limits installed. Therefore we would suggest checking with the local county;
• There is however a limit on the total value of the small estate. In New Jersey if you are the spouse of the decedent, the value should not be bigger than fifty thousand dollars. For other individuals, this is capped at twenty thousand dollars;
• The document should also be notarized in accordance with local state laws.
