What Is a Lease Amendment?

A Lease Amendment is a supplementary document the parties to a commercial or residential lease agreement may use to change the terms and conditions of the contract. If after several months or years of contractual relationship one of the parties or both of them wish to amend the lease, they have a right to do so provided that both the owner of the property and tenant give their consent.

There is no need to draft a new lease every time you make a change - simply attach a short statement that explains what is going to change in the text of the lease to the original agreement. The property owner may let the tenant own pets in the house or apartment in question, raise the rent amount for the business that rents a retail store, or specify the rights and duties of the parties when it comes to the maintenance and repair of the rental property.

How to Write a Lease Amendment?

Once the property owner and the tenant have determined what they need to change and want to obtain a formal record of the modification, they need to follow these steps to compose an Amendment to a Lease Agreement:

  1. Record the names of the parties signing the amendment and refer to the original lease - enter its title and the date of signing. You may also add the address of the rental unit to make sure there are no misunderstandings.
  2. Certify you agree to amend the lease agreement and only the provisions indicated in the present contract will be amended - all other terms and conditions remain legally binding.
  3. Highlight the clause in the original lease that is going to be replaced or slightly modified. It is better to quote it and add the words "is replaced by" below.
  4. Write down the new clause. Even if you are adding one word to an old sentence and this is the only change you are making, it is recommended to clearly define what you have amended. For example, you may change the day of the week the tenant pays the property manager or otherwise modify the payment schedule.
  5. State the date the amendment comes into force and indicate its duration. While it is common every modification is valid for as long as the lease, the parties are free to decide differently - for example, giving the tenant a right to sublet the apartment for three months from the date of signing the papers.
  6. Sign and date the amendment confirming it becomes an essential part of the lease.
  7. If the original agreement was signed in the presence of witnesses or notary public, you should do the same with the Amendment to a Lease - besides, since the modification is considered an integral part of the contract, it is a good idea to give all the provisions, old and new, the same level of protection.
