Using a New Mexico Self-Proving Affidavit Form is not a legally necessary document, but it would still be beneficial to create one. The main purpose of this document is to confirm the validity of a will created by a person. The big advantage of this is that it will decrease the probate process timing which occurs in court and will usually be a long process. This occurs because witnesses do not need to show up at the court in person – the signatures they include in a New Mexico Self-Proving Affidavit will be sufficient.

In agreement with the regulations set in New Mexico, which regulate the creation and implementation of this form, it stipulates that the document should be signed by both the person creating the will and in addition to this, two witnesses. This should all be done in front of a notary public and any people failing to comply with the regulations set out concerning signing, the document will not be valid.
