Self-proving Affidavit Form - South Dakota

As a legally binding document, a South Dakota Self-Proving Affidavit Form is directly attached to a person’s will. The aim of the document is to confirm to the court that the will is real and that the person who made the will was not forced to include anything against their wishes. This is important because it minimalizes the probate processing time which is generally long. This then means that any people named in the will are free to collect their inherited assets much faster.

The South Dakota Self-Proving Affidavit state laws say that apart from notarization, two people would also need to serve as witnesses to see the creator sign the will. The notary public must also be present. The people that are outlined as witnesses in the document do not need to go to the court physically – the signatures that they include will act as validation. However, if state signing laws are not enforced the document will be invalid.
