Is a Bill of Sale Required in Michigan?

A Michigan Bill of Sale is a name used to describe the documents filled out during the sale and purchase of different items in the state of Michigan. These documents are considered legal proof of the deal accepted by all state agencies. Michigan Bills of Sale are usually divided into the following types:

  1. Michigan Generic Bill of Sale. The document is typically used to record the sale of personal items. Though the form is not required by the state authorities, and there are no official documents you can use for this purpose, both the sellers and the buyers often prefer to create it;
  2. Michigan Vehicle Bill of Sale. The State of Michigan does not have any government-issued form you can use to document the sale of your car. A basic template will be accepted if it contains the required information;
  3. Michigan Boat Bill of Sale. You must fill out Form TR-207, Bill of Sale for a Trailer, Watercraft, Snowmobile or ORV issued by the Michigan Secretary of State every time you sell or buy a boat within the state. The same form is used to record the transfer of a trailer, ORV, or tiny home;
  4. Michigan Firearm Bill of Sale. The Michigan State Police requires the completion of Form RI-060, Pistol Sales Record when selling or buying pistols. The document is filled out in three copies: seller’s copy, buyer’s copy, and registry copy submitted by the buyer to the local police or sheriff’s office.

The Michigan Department of Agriculture and Rural Development, Pesticide & Plant Management Division has issued its own Form PI-087, Bill of Sale. This document must be filled out in order to cut, remove, or transport Christmas trees, evergreen boughs, and other wild trees.

Michigan Bill of Sale Requirements

Except for the government-issued forms, a Bill of Sale in Michigan does not have any special requirements. The document is considered legal as long as it contains the following information:

  • Identification information about the seller or sellers;
  • Identification information about the buyer or buyers;
  • The detailed description that allows to clearly identify the sold item;
  • Date of sale;
  • Sales price;
  • Signatures of both parties.

All entries must be legible. The document cannot contain crossings or whiteouts. When creating your own document, you can complete it with additional information, like any special terms you and the buyer agreed upon, type of payment, and other relevant information. The notarization of the document is not required, but you can choose to have one to add an extra layer of protection to your deal. The same relates to the witnesses’ signatures.

Remember, that you can add extra information and blocks to your bill of sale only in the event when a government-released form is not required. If the official form is available, you must fill it out according to the rules applicable to a specific document.
