The Minnesota Bill of Sale is an important document created during the transfer of different kinds of items from one party, officially called the seller, to another, called the buyer. It is oftentimes used to record the details of a transfer between private parties. The properly completed document is equally important to both, the seller and the buyer, as it states the legal interests of both parties and protects them against any possible fraudulent claims that may arise in the future.
There are five main types of the Minnesota Bills of Sale:
- Minnesota Generic Bill of Sale is typically created to record the transfer of personal property between private parties. It can also be used in the event when no specific form is available;
- Minnesota Vehicle Bill of Sale. This form is used to document the sale of all types of vehicles. Two counties in Minnesota issued their local forms for this purpose:
- Aitkin County released the bill of sale with the full purchase price used to record the transfer of non-titled vehicles;
- Jackson County has an official form the seller has to fill out when transferring ownership of a mobile home;
- You have to file a Minnesota Boat Bill of Sale to record the fact of transfer of the boat licensed in Minnesota;
- Minnesota Firearm Bill of Sale is created to document the details of a gun transfer.
- Minnesota Real Estate Bill of Sale is a form released by the Minnesota State Bar Association and used when selling personal real estate.
Minnesota Bill of Sale Requirements
The State does not require you to document the sale of a firearm or personal property. The Bill of Sale in Minnesota is necessary only when transferring ownership of a watercraft or a vehicle not subject to titling. However, you are recommended to create the document even in case it is not required by law in order to have important evidence of the item transfer. The state does not have any special requirements for its look and content.
For the document to cover all aspects of the sale, make sure it contains the following:
- Identification information and addresses of all sellers and buyers involved;
- Full description of the transferred item. The description you enter must help to identify this item unmistakably. If the property you sell has any defects, they must be disclosed to the buyer and listed on the document;
- Terms of the sale. At a minimum, indicate the date of sale and the sales price. If there are any additional terms, enter them as well;
- Signatures of all sellers and buyers involved.
The Minnesota laws do not require you to notarize the document.
