Do You Need a Bill of Sale in Minnesota?

The State of Minnesota does not require to fill out a bill of sale when selling or buying personal property or other minor items. At the same time, the document is very useful for both the seller and the buyer, and they often prefer to sign it. If properly created, it serves multiple purposes:

• Releases the seller from the responsibility for the transferred item;
• Proves the buyer is the new owner of the described item;
• Provides the important details of the transfer, like the date of sale, sales price, description of the sold item, identification information of all parties of the deal, and others;
• Serves as a purchase receipt.

The State does not have any specific requirements as to the looks and content of the Minnesota Bills of Sale. However, for the document to protect your legal interests safely, it should contain the following blocks of information:

1. Seller's Information . Provide the name and address of the seller. It is recommended to specify the driver's license number as well;
2. Buyer's Information . Enter the same set of information for all buyers and co-buyers;
3. Item Description . Provide all the details necessary to describe and identify the sold item unmistakably. The details you need may include the make, model, year, color, size, serial number, and others. If you sell an item with any accessories, list them on the document and provide a description for each of them;
4. Defects . If the item has any defects you know about, inform the buyer about them and list them on the document;
5. Details of Sale . Indicate the date of the sale and the sales price. If there are any special terms and conditions, include them as well. (E.g., you give the described item as a gift, the buyer pays in several transactions, you will deliver the sold item to the buyer later, and others). If the case involves postponed payment, delivery, or payment in several transactions, always specify all dates you agreed upon and the sums due;
6. Signatures . The form should be signed by all parties of the deal.

Prepare the document in two copies for each party of the deal.

Does a Bill of Sale Need to Be Notarized in Minnesota?

As of this year, there are no legal requirements to have the Minnesota Bill of Sale notarized.
