What Is a 30-Day Notice?

A 30-Day Notice is a type of formal letter sent by a landlord (property manager) to a tenant to inform the latter their Rental Agreement will be canceled and the premises must be vacated - either because the tenant has violated the rules of the contract or due to other circumstances. This document must be prepared and mailed to the breaching party one month before they leave the residence or office space giving them enough time to move out and find another house or commercial real estate.

If the agreement you have signed with the tenant obliges you to inform the other party about the upcoming eviction ten or sixty days before they must leave your real estate, you need to use a 10-Day Eviction Notice or a 60-Day Notice.

How to Write a 30-Day Notice?

Follow these steps to compose a simple 30-Day Eviction Notice:

  1. Greet the recipient by their full name. If there are other people that occupy the property or you are sending a letter to a business, add all the relevant names as well.
  2. Identify the premises you are referring to by its legal address and mention the original rental agreement you have signed with the other party.
  3. Inform the party they have violated a particular clause in the document - for instance, they failed to make a payment on time, did not allow you to visit the house or office if there is such a responsibility in the original contract, or damaged the property which can be grounds for the lease termination and eviction.
  4. Indicate the date the tenant must vacate the property.
  5. State whether you are keeping the security deposit as compensation for damages inflicted by the tenant. If there is a matter of unpaid rent, describe your intentions regarding this sum of money - give them an opportunity to pay you back before they leave and before you sue them.
  6. Offer the other party to stay in touch - they may want to discuss the eviction further, maybe, even talk to you in person. There is always a possibility they fix the existing problem without delay, so if you are ready to reconsider eviction, give them a chance to do so, but do not wait too long.
  7. Sign and date the letter.

You may deliver the notice personally - make two copies for yourself and the tenant, with the other party signing and dating your document to certify they have received the notice on time. Alternatively, you can use certified mail to obtain a receipt - it will be invaluable in case there are disputes and disagreements later.
