What Is a Remodeling Contract?

What Should Be in a Remodeling Contract?

A thoroughly written Home Remodeling Contract is filled with stipulations and numbers that will take many hours to review, so establish a meeting with the other party to examine every provision of the contract before signing it.

A simple Remodeling Contract contains the following information:

  1. Names and addresses of the parties;
  2. Description of remodeling services and the address where they must be performed. State which party has to furnish the materials, supplies, and labor to perform the services adequately. Determine the team the contractor will use to finish the work. If the contractor must remove all the debris upon completion of the services, mention it in writing;
  3. Remodeling schedule. Submit the start date, substantial completion date (indicate the percentage), and full completion date;
  4. Payment schedule. Write down the sum of money the customer pays the contractor upon the execution of the agreement and completion of all services;
  5. Safety precautions. Add references to all applicable laws, rules, ordinances, and regulations related to the safety of people and property;
  6. Termination. Usually, the contract can be terminated when one party gives the other a written notice;
  7. Signatures that acknowledge a full understanding of the terms and conditions of the agreement. Once a Home Remodeling Contract is signed, it becomes legally binding.

What to Look for in a Remodeling Contract?

It is a wise move to avoid an allowance - a specified amount of money for a certain job not outlined at the time of signing the papers. Sort out all the materials and products before the contractor gives an itemized bid for the job, otherwise, the final cost of the remodeling will be much higher than what the customer wants to spend.

Establish a good rapport with another party. Try to meet at least once a day to share progress reports and decide what work should be scheduled over the coming days. It is a good idea to keep a project journal to write down ideas and record number, as well as note upcoming stages of remodeling.

5. Liens and Waiver of Liens. The Contractor agrees to provide the Customer with
lien waivers, lien releases, and/or acknowledgement of full payment upon receipt of
each payment laid out in Section 4.
6. Events Beyond Contractor’s Control. The Customer agrees that if the Contractor
is unable to complete the Services by the Completion Date because of reasons that
were not caused by the Contractor (i.e., availability of necessary supplies, materials,
etc.) or because of events beyond the Contractor’s control (such as labor issues, fire,
flood, acts of God, vandalism, etc.), the Contractor will not be deemed to have
breached this Contract and the time for the Contractor to complete the Services will be
extended by the amount of time reasonably necessary for the Contractor to complete
the Services and at a schedule agreeable to the Parties. The time for the Customer to
pay the Contractor for the Services will be extended in the same manner.
7. Safety Precautions. The Contractor will take all reasonable safety precautions in
performing the Services. The Contractor will comply with all applicable laws,
ordinances, rules, regulations, and orders of public authorities for the safety of persons
and property. The Customer agrees to keep the Property clear of all known and
potential hazards. The Customer further agrees to keep all pets out of the work area of
the Property.
8. Liability Waiver. If the Contractor, any of their employees, contractors, agents, or
the like are injured in the course of performing the Services, the Client is exempt from
liability for those injuries to the fullest extent allowed by law.
9. Termination.
9.1. By Customer. ​ T he Customer can terminate the Contract by giving written notice:
a) if the Contractor commits any material breach of this Contract and fails to
correct the breach within _____ days of notice of the breach; or
b) if there is any repeated failure by the Contractor to provide the Services of an
acceptable standard and to the reasonable satisfaction of the Customer.
9.2. By Contractor. ​ T he Contractor can terminate the Contract by giving written
notice:
a) if the Customer fails to make the payments required and set forth in Section 4
within _____ days of the required date; or
b) if the Customer commits any other material, non-financial breach and fails to
correct the breach within _____ days of notice of the breach.
10. Entire Agreement. This document reflects the entire agreement between the
Parties and reflects a complete understanding of the Parties with respect to the subject
matter. This Contract supersedes all prior written and oral representations. The
Contract may not be amended, altered or supplemented except in writing signed by
both the Contractor and the Customer.
11. Dispute Resolution and Legal Fees. ​ I n the event of a dispute arising out of this
Contract that cannot be resolved by mutual agreement, the Parties agree to engage in
mediation. If the matter cannot be resolved through mediation and legal action ensues,
the successful party will be entitled to its legal fees, including, but not limited to
attorneys’ fees.
12. Severability. In the event that any provision of this Contract is deemed invalid or
unenforceable, in whole or in part, that part shall be severed from the remainder of the
Contract and all other provisions should continue in full force and effect as valid and
enforceable.
13. Legal Fees. ​ I n the event of a dispute resulting in legal action, the successful party
will be entitled to its legal fees, including, but not limited to its attorneys’ fees.
14. Legal and Binding Contract. This Contract is legal and binding between the
Parties as stated above. This Contract may be entered into and is legal and binding
both in the United States and throughout Europe. The Parties each represent that they
have the authority to enter into this Contract.
15. Applicable Law. ​ T his Contract shall be governed and construed in accordance
with the laws of the state where the Property is located, without giving effect to any
conflicts of laws provisions.
BY SIGNING BELOW, THE CUSTOMER ACKNOWLEDGES HAVING READ
AND UNDERSTOOD THIS CONTRACT AND BEING SATISFIED WITH THE
TERMS AND CONDITIONS CONTAINED IN THIS CONTRACT. THE
CUSTOMER SHOULD NOT SIGN THIS CONTRACT IF THERE ARE ANY
BLANK SPACES. BOTH PARTIES ARE ENTITLED TO A COPY OF THIS
CONTRACT AT THE TIME THEY SIGN IT.
