A Letter of Intent to Sue is required to inform a prospective defendant that a claim against them may be presented in court. The letter will sum up the supposed illegal breach and outline a period of time for which a defendant has the opportunity to resolve the issue in order to prevent a legal battle from commencing.

Conveyance of this notification is regularly legally necessary and should be sent by means of guaranteed mail prior to commencing the process of a court hearing. In any case, even disregarding the legal requirement, the document should still be presented to the defendant to assist with accomplishing a common understanding between parties and avoiding an expensive lawsuit. Usually, this will include a settlement demand, a sum that the defendant has to pay in order to prevent a lawsuit.

How to Write a Letter of Intent to Sue?
There may be several reasons as to why an individual will decide to sue an organization or individual. The first step should always be to provide a Letter of Intent. Conveying a letter of intent will go into the court's records to demonstrate that there were attempts to resolve the case before reaching the stage of filing a lawsuit. A Legal Letter of Intent to Sue should generally include the following structure:
- Information of the person who is sending the letter. This should include their full name and address for correspondence.
- The date from which the letter is deemed as effective.
- The subject of the letter: the notice of your intention to make a claim against the defendant.
- Outlining the party to whom the letter is intended (the defendant).
- The name of the individual sending the letter.
- In detail, explain the reasons as to why you are suing the defendant. Include what was breached and the law that this violates.
- Information about both parties should be outlined separately. The individual bringing forward a case should be named as the Plaintiff. The party that is being sued should be named as the Defendant.
- Details of a settlement demand. Here you should include the sum of which the Defendant can pay the Plaintiff in order to resolve the conflict and prevent a legal battle. This demand is valid only for a certain period of time. This time period must also be outlined in the settlement demand section.
- Provide information regarding which state laws the letter will be governed by.
- The person writing the letter should print their name and sign the document.
Ensure that you provide all the relevant information and that you have proof of any breaches or violations. The more detailed your letter is and the more evidence you have, the more likely you are of making a successful claim. Remember that big businesses in particular have a whole team of legal experts who will try and find loopholes in any information you provide.
