How to Sell a Boat in Virginia?
A properly completed Virginia Watercraft Bill of Sale form should contain the following information: the full names, addressed, ID numbers of both parties of the transfer and full description of the vessel, price, date, and signatures. Additionally, you will need to file Form BRT-010 - a form used to register and title a new or used boat - with a detailed description of the watercraft, including the make, length, and model year, type of vessel, hull material, hull number, horsepower, and the serial number of the motor.
The new owner of the watercraft may use the vessel for 30 days from the date of purchase, having the Bill of Sale and valid Certificate of Number from the former owner. After that, the new owner must apply for a transfer of ownership using the forms provided by the Virginia Department of Game and Inland Fisheries.
While transferring your vessel, you may be required to fill out some other forms provided by the Virginia Department of Game and Inland Fisheries :
- Form BRT-003, Certification of Authority to Transfer Watercraft Registration/Title when the Owner is Deceased is required if the holder of a registration certificate of vessel title has passed away.
- Form BRT-004, Affidavit for Transfer of Certificate of Watercraft Registration/Title is used when the new owner cannot obtain the title from the seller.
- Form BRT-005, Affidavit for Transfer of Watercraft Title and Registration by Operation of Law is applied when the new owner received ownership in cases such as bankruptcy, divorce, execution sale or court order.
- Form BRT-006, Abandoned Boat Affidavit is used to apply for ownership of a boat abandoned on your property for at least 60 days.
- Form BRT-007, Titling/Registering Watercraft for Estray and Drift Property is used to apply for ownership of boats that have been washed up on your property or found adrift on the public waters.
Does a Boat Bill of Sale Have to Be Notarized in Virginia?
The state of Virginia does not require a notary public's certification for sales but it is generally a good idea to have a notary or witness to a sale in order to confirm the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
