How to Write a Bill of Sale in Virginia?

Virginia State laws do not require a Bill of Sale to be filled out when transferring property (except for the Vehicle Price Certification, Form SUT 1) to certify the purchase price of a motor vehicle more than five years old.

A Generic Bill of Sale form is signed in duplicate and should include the following:

  1. Full personal information about the seller and the purchaser, including their names and physical addresses;
  2. Description of the items being transferred. Provide all the necessary details for the identification of the goods: general description (e.g., color, size), serial number, manufacturer, year. Describe the defects if the item has any;
  3. The price of the indicated item. If the property is given as a gift, indicate it on the form as well;
  4. Every document must include the sale date and the signatures of the seller and the buyer.
  5. The seller and the buyer should state warranties where it is indicated that the buyer accepts the goods "as is" if the conditions of the guarantee are described if the seller provides them.

Does a Bill of Sale Have to Be Notarized in Virginia?

No, Virginia does not require a notary for Bills of Sale but it is generally a good idea to have notarization or witness to a sale in order to confirm the transaction has taken place. This can save any possible trouble that might occur if the seller or buyer contest the transaction at a later date.
