How to Fill out a Beneficiary Deed?

Provide the following information in your Beneficiary Deed Form:

  1. Identification of the beneficiary. It is allowed to name anyone as the beneficiary of the deed - one person, many people, or a certain organization. Very often the beneficiary is a family member, friend, or the benefactor's preferred charity fund;
  2. Full description of the property you leave to the beneficiary through the deed;
  3. Signature of the property owner. If you own the estate with someone else, for example, your spouse, you both have to sign this document. It is necessary to obtain the notary public's acknowledgment of your intent to transfer the property via the Beneficiary Deed.

Once your deed has a notary seal, you need to file it with the local public records for the state or county in which the real property is situated. This records office is typically called the county registrar or recorder. Without this, the deed will be unenforceable. Usually, there is a small filing fee you pay when the clerk makes a copy of the deed for the public records - the original document will stay in your possession.
